Terms and Conditions

I. General Terms

Please present your request in a nice manner.

Provide neat references or descriptions.

Only present the information necessary. I will be in touch if something is not clarified.

Ill behavior will not be tolerated and your commission will be canceled should it occur.

Follow the rules provided here and within my commission information.

Failure to adhere to these terms I hold the right to decline your commission.

II. Payment

All commissions must be paid in full upfront.

The currency accepted is USD (United States Dollars).

Payment will be sent through PayPal before the work has started.

III. Process

Works in Progress will only be given if the commissioner personally requests them, or should I need clarification on a detail of the piece.

The time of your commission to be completed can be up to 4 months depending on many factors such as health, order of commission, complexity, college, or family issues.

If any of the things stated above occurs you will be notified ASAP.

Commissions can be refunded up until the point of which I start on the piece. After that, a partial refund can be given along with the piece at the state it is at once cancelled. This is negotiable on a case-by-case basis.

IV. Customer Satisfaction

I will do all that is in my power to make my customers happy.

Once a piece is finished, I will ask if any changes must be made. I will do my best to work on a piece until the customer is completely satisfied with the work.

V. Copyright / Usage Policy

I, the artist, hold every right to the produced drawing, not the commissioner.

Therefore, I am allowed to use the copyrighted artwork to;

• Promote myself within any place or site.
• Publish books with.
• To display it anywhere to my liking.
• Post it wherever I want.

The commissioners are allowed to;

• Use the copyrighted artwork for personaly use only unless agreed on otherwise.
• Print the art, and claim the right of the character(s) but not the drawing itself.
• Use the art to promote themselves with proper credit given to the artist.

If you break the copyright infringement in any way, every right you had to the drawing will be retracted.

The following is considered Copyright infringement:

• Reproducing/using the copyrighted artwork commercially. (Meaning making money off of it in any way)
• Taking Credit for the creation of the artwork.
• Removing any watermarks/signatures.
• Altering the artwork without my, the artist's, consent.
  

A Purchase of Commercial rights are currently unavailable at this time.

This means the rights to my artwork cannot be purchased to be made into any sort of merchandise, or used in products such as books, covers, as Props, changed, or promoted for a brand.

Please inquire regarding this if you are insistent.

Credit is always required for usage of the artwork regardless.

VI. Canceling / Refunding Policy

I have the right to cancel and refund the money of your commission at any time.

You have no right to cancel or demand a refund from the artist under any circumstances after payment is received.

As stated before, commissions can be refunded up until the point of which I start on the piece. After that, a partial refund can be given along with the piece at the state it is at once cancelled. This is negotiable on a case-by-case basis.

If money has not been sent yet, the commissioner has the right to cancel the commission.

If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.

• You will be forbidden to ever commision me, Bogwarden, ever again.
• Your name will be blacklisted and likewise may be publicly listed where I want to warn others to watch for this behavior.

I also have every right to file a complaint and I have all the right to the money you have given me.

***Note that as of 10/30/2021, the name "Volbeatic" has been used and is still under my name. All future works will be signed "Pathos". All old pieces still have my prior alias but still adhere to all terms as listed above.
